Ohio Inmate Claims He's Too Fat to Be Executed
COLUMBUS, Ohio — A death row inmate scheduled for execution in October says he's so fat that Ohio executioners would have trouble finding his veins and that his weight could diminish the effectiveness of one of the lethal injection drugs.
Lawyers for Richard Cooey argue in a federal lawsuit that Cooey had poor veins when he faced execution five years ago and that the problem has been worsened by weight gain.
Cooey, 41, was sentenced to die for raping and murdering two female University of Akron students in 1986. After a federal judge granted Cooey a last-minute reprieve in 2003, Cooey was returned to death row. In April, he lost a challenge to Ohio's lethal injection process when the U.S. Supreme Court said he had missed a deadline to file a lawsuit.

Cooey's use of the drug Topamax, a type of seizure medication, may have created a resistance to thiopental, the drug used to put inmates to sleep before two other lethal drugs are administered, Dr. Mark Heath, a physician hired by the Ohio Public Defender's Office, said in documents filed with the court.

"All of the experts agree if the first drug doesn't work, the execution is going to be excruciating," she said.
Painful execution of vermin may be cruel, but it should NOT be unusual. Constitution upheld. Problem solved.

Take him off the seizure meds a couple weeks before. I mean what the hell does it matter if he seizes? He's on death row and scheduled to die. This is just ridiculous!

Ya know, the entire court system and even the Congress itself found no Constitutional problem in sentencing a woman - Terry Schiavo - to death by starvation for considerably less than this guy has done. I say it's time this form of capital punishment is put into widespread use, and I vote we start with THIS lard ass.

CINCINNATI — Ohio executed a 5-foot-7, 267-pound double murderer who argued he was too fat to die humanely by lethal injection on Tuesday, the state's first execution since the end of an unofficial national moratorium.
Richard Cooey, 41, had argued in numerous legal challenges that his weight problem would make it difficult for prison staff to find suitable veins to deliver the deadly chemicals, a problem that delayed previous executions in the state.
There were no such difficulties, said Larry Greene, a spokesman for the Southern Ohio Correctional Facility.

Cooey was 75 pounds heavier than when he went to death row — the result of prison food and 23-hour-a-day confinement, his lawyers said.

hehe Here's what happens in Texas when they are medically 'unfit' for execution;
Whether the steady beat of executions will cause disquiet for the Bush campaign is far from certain. The potential for distasteful headlines became apparent last month when Texas officials chose to remove a hospitalized inmate from intensive care, where he had been taken after a suicide attempt, and fly him directly to the death chamber, rather than stay his execution.
Now, if W can win a Presidential election with this kind of attention ..... McCain shouldn't have a problem.

While I'd love to agree with your interpretation, the problem is that English is NOT a logical language. It seems most likely to me that the "and" in "cruel and unusual punishment" is not a logical AND at all, but a logical OR.
On the other hand, I'd love to see something - anything - that might put my interpretation to rest. Believe me, I WANT to be wrong.
