That's the route the prosecution took. Unfortunately, they also need a viable legal case to get a conviction.

Mosby campaigned on going after BPD, and she's keeping her campaign promise, at taxpayer expense. A prosecutor interested in justice would have declined to prosecute this set of cases. Gray was killed by his own stupidity in continuing to resist arrest. A rational prosecutor, having lost 3 cases and had a hung jury in a 4th, would give up on the 2 untried and the 1 that resulted in a hung jury. Unless some person or agency to which she is accountable forcibly stops her, I think she'll proceed onto the next target of her malicious prosecution.
