Why isn't this person in jail?

For the same reason Jesse and Sharp Al aren't, their skin color and celebrity. Take away either and they probably would be. The cdurrent occupant of the WH makes this even more certain, but hopefully that extra layer of protection starts to go away in January of 2017.
