I also tried to absorb some of my wife's debt in a chivalrous but ill-fated move. My wife lost a decent paying job earlier this year through no fault of her own and is now working for $7.50 an hour. We need her income to help pay the bills, but she has been unable to find anything better.

I've tightened my belt and we've cut out things to try to make it work. I've leased my condo when I could. But even on our bare bones budget we're still coming up about $600 short a month. My savings are down to about $3000. If I manage to lease my condo again it will only give us about five more months before we are out of money. Might as well file now and put an end to the stress.

I qualify for chapter 7 bankruptcy. It will wipe out about $1300 a month in debt payments so we'll be back on the positive side again. I'll get to keep my car. Our house is in my wife's name and she is not filing. It will make my credit look shitty for a long time, but I don't foresee us needing credit any time soon. The next big thing will probably be a car for my wife and I think her current one will last another three or four years.

My wife was upset, but when I explained everything to her, she felt better about it. She made the comment that ever since we've been married we just can't seem to catch a break. I told her that this is a break. Imagine if we weren't able to do it.

My understanding of Tob's post is that he won't be screwing his creditors out of that additional $16,000 by maxing out his credit card(s) before filing bankruptcy. How generous and magnanimous of him.

But your last sentence is correct, in two ways. Productive taxpayers will be the ones paying for any government social program bennies Tob might receive. And the unpaid debts of every person going bankruptcy are "paid" by solvent people, through those costs being part of the price of every product and service and the interest rates charged by banks and other lenders. Tob's lunch is only free to him.

Sounds pretty :bouncy: -oid. If Tob's is really going bankrupt - Chapter 7 or 11 - his "question" is meaningless. The court will divy up his assets among the creditors. OTOH, if he pays off a creditor before going bankrupt, that might be evidence that he has the ability to pay his debts, over time, and should not be allowed the protection of bankruptcy.

That was rsmithnumbers. He took student loans to go to truck driving school for three years.

After all that higher education, he repeatedly failed his test for a license, due to crashing into the dock or stopping way short.

When last seen, he was piloting a shuttle between motels and the airport.

He disappeared a year or so ago - I suspect he's either dead or got lost on the way to the airport, couldn't back up, and never returned.

Tobin S. is a loony who has episodes of insanity when he spends weeks sleeping in his car.

I believe he's saying the $16K is the amount of credit he has available to him on various credit cards, not his total debt, which is undoubtedly much higher...deficiency payments on sale of the truck, the deficiency on the upcoming underwater sale after foreclosure for the condo, the actual balances on God knows how many credit cards, and all sorts of other debts.  Timing is everything in bankruptcy, he better make sure the bank does the foreclosure and fire sale on that condo before he has to file his final schedule of debts and creditors.

Well, one has to give the rsmith primitive kudos for that, staying away from Skins's island while he's running for a public office.  Since being known as a member of Skins's island automatically paints a person as a primitive--and so accurately so--it's just not a good idea.

If the big guy in Bellevue had stayed away, he'd probably been elected in a landslide, and right now sitting in hog heaven raking in the pay-offs for this or that, and with no fantasies about being terminal.
