Lt. Col. Joni Ernst, the junior senator from Iowa, is an active duty lieutenant colonel in the Iowa Army National Guard. As such, she is bound by the Iowa State Code of Military Justice. Her signing of the seditious letter to Iran is a clear and direct violation of Chapter 29B.85 of the Iowa State Code of Military Justice.
29B.85 CONTEMPT TOWARD OFFICIALS.
Any person subject to this code who uses contemptuous words against the president, the governor, or the governor of any other state, territory, commonwealth, or possession in which that person may be serving, shall be punished as a court-martial may direct.
This is very serious infraction. We are a nation governed by civilians. Our Commander-in-Chief is a civilian. The government officials that hold ultimate authority over our military are civilians. This is true at the federal level and the state level. This has always been the case since George Washington was president. He resigned his military commission to accept the position of president. We have never in our history had a military ruler. Military obedience to civilian authority is critical and essential if we are to maintain the democracy we inherited. That is why "contempt towards officials" is such a serious matter. Lincoln enforced that discipline during the Civil War. Even with the imposition of martial law, Lincoln remained a civilian commander. Truman enforced the same discipline after WWII when he relieved Gen. MacArthur of his command. Obama enforced the same discipline recently when Gen. McChrystal was relieved of his command. There is nothing anachronistic about this fundamental principle.
In the federal armed services, this is handled under Article 88 of the Uniform Code of Military Justice.
“Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.â€
Reading the federal version, it is obvious where Iowa got the wording for its law. It's not an accident or a coincidence. The importance of enforcing the requirement for military obedience to civilian authority is universally applied at every level of governance, from the federal to the local level. This is why we are not a police state.

GI Joni won't finish her term. Joni will resign in shame just like Palin. This current scandal is just the latest of many. We need to keep hounding her until she has to answer every day for the crimes she and her family have committed. Joni is the weak link, she has no business being a United States Senator, she was not vetted, her election was a fluke, she has no real support back home. We need to put pressure on her and make her fold like a house of cards.
Imagine what a gift it would be for our side to have this junior senator embroiled in scandal leading up to the 2016 election? We need to keep pushing day after day the anti-joni message, write letters, make calls, fan the flames. Show the world just what a disgrace this woman really is.

He is an active Reservist. He should be scrutinized just like Earnst in my humble opinion. Are we being harder on her?
No he's not AGR (Active Guard/Reserve). At most Colonel Graham is a traditional Air National Guardsman, once a month two weeks every summer.

This from the same people that was encouraging myself and others in uniform to ignore the orders of the President and our commanders...when they weren't advocating for us to shoot them or have someone spit on us when no one was looking.

kaput's knowledge of the UCMJ wouldn't fill a thimble.
Ernst wasn't on any kind of state or federal active duty orders (which means she wouldn't have been there to sign the letter anyway)...nor was she serving during Annual Training or a weekend drill.
She didn't appear on the floor of the Senate in uniform...so you're just SoL on this one.
And besides...if you primitives REALLY want to go down this road...let me remind you of this...Tammy Duckworth, LTC Illinois Army National Guard. We Conservatives can demand she be held to the same standards you want to hold Joni Ernst to.
Don't forget too DUmmies that D Student Kerry was still a Lieutenant in the Navy when he went and lied before that Congressional comittee in 1972.

I might be confused, but if Senator Ernst is serving in the senate, how can she also be "...active duty..."? I would think she is more like a weekend a month member until/unless her unit is activated.
I think kpete might be confused and grasping at straws - but I might be wrong about all of the above.

There's a whole lot more to proving an Article 88 case than kaputt thinks, and then there is the whole "On active duty" thing for jurisdiction, which Ernst would not be unless she was actually serving on AT or mob orders at the time she signed the letter...which of course she was not.

Joni Ernst is so busted. Not just chapter 29B.85 of the Iowa State Code of Military Justice, but the Logan Act too. The double whammy.

Yo dummie? When the senate is in session, the senators are protected, by law, from arrest for anything they say while acting as a senator. See Harry Reid for good examples. A letter is nothing more than a statement put on paper.

That is an active Reservist. Inactive Reservists don't drill.
FULL DISCLOSURE: I was AGR with ILARNG
EDIT: It can be a bit confusing. You have your standard Active Reservist who drills monthly and does AT's. You have Individual Ready Reserve, which are technically, inactive. They periodically show up for paperwork and such until their remaining commitment is done. There is Inactive National Guard that I never completely figured out the difference from IRR. AGR is samey same 24/7/365 active duty only you are assigned and part of that unit in an AGR slot. In days of yore, these slots were Civil Service GS-5/GS-7. Civilian during the month and Guard on the weekends. Out in the Maintenance Shops (OMS), you have another system, Wage Grade (WG). It's a zoo. The Federal Techs in the shops resisted (Union) going AGR and have still been successful, as far I know.

Generally the phrase 'Active Reservist' is avoided because of the confusion it creates, since it would not mean "Active DUTY Reservist," since that's something else entirely. What you are talking about is more usually (And technically) called the Selected Reserve, which is all the TPU, IMA, and AGR personnel, which are all 'Active Reservists' but, except for the AGRs, not on 'Active duty' except when on AT or mob orders (Weekend drills are not 'Active duty' for the TPU and IMA people, they are 'Inactive duty for training' or IADT). Almost all provisions of the UCMJ require the jurisdictional language 'On active duty,' cutting out prosecution of anyone besides the AGRs unless the person is on AT, ADT, ADSW, or mob orders. The State military codes may be a little broader when it comes to offenses like unauthorized absence or missing movement for what would be IADT time, though they would be only 'Unsatisfactory participation' admin offenses from the Federal point of view since the "On active duty" element of the offense could not be met.
