Obama mandate ruled unconstitutional

WASHINGTON — (Reuters)  A U.S. appeals court ruled Friday that President Barack Obama's healthcare law requiring Americans to buy healthcare insurance or face a penalty was unconstitutional, a blow to the White House.

The U.S. Appeals Court for the 11th Circuit, based in Atlanta, found that Congress exceeded its authority by requiring Americans to buy coverage, but also ruled that the rest of the wide-ranging law could remain in effect.

The legality of the so-called individual mandate, a cornerstone of the healthcare law, is widely expected to be decided by the U.S. Supreme Court. The Obama administration has defended the provision as constitutional.

The legislation didn't have a severability clause did it?

If any portion is ruled unconstitutional, the whole thing is.

At least that is what I recall from previous news articles on this POS law.

Hi,

Folks I was as excited as anyone with the court ruling but let's not forget this.  The government still has the right to go into the health insurance business.  So if there is no mandate, that only helps a little.  The government still can price all other insurance companies out of the market so they are the only one left standing.  

Point is the whole damn bill needs to be ruled unconstitutional.  The last thing we need is for them to "freeze" all other aspects of the law and then try to figure out how to fix the one exception.  My fear is the libs will try to do just that and there is a whole lot more in that bill that is unacceptable.

We need to make sure that whoever finally wins the nomination is very clear that the first thing they are going to do is bust their butt to get the entire law repealed!

That is exactly what Obama and the left wants.  Without all the young healthy people being forced to buy insurance, the companies will go bankrupt having to insure all the old, and sick  and those who soon will be. Insurance companies go tits up, then people will demand the government insure them.
