The article said that the first process was to determine if the perp is sane. The consensus seems to suggest that he is. Now, it goes to a court martial but to make it a capital case (meaning max punishment if found guilty is death), a general officer has to weigh in. They're waiting till 23 Feb or so for a LTG to become available.
Bottom line, it's a court martial. The crime occurred on a US military installation, which means (I think) that the feds have first crack, and maybe the only crack, at this perp.
