What's the difference between paying "hush money" versus reaching a "settlement" in the event of a civil court case or, more likely, a threatened civil court case? Simply because paying "hush money" is private versus a "settlement" is public? I confess, I don't get it. Stormy Daniels, by all accounts, is a whore. She gets paid for her sexual services. So what if Trump "hired" her? Even if he did, which he denies.

Trump, who would reportedly be the first former president to face an indictment, will surrender to face the criminal charges in Manhattan if such an indictment is returned, Trump's lawyer Joseph Tacopina has said.

As Leah reported, Trump and his team maintain that the former president is "completely innocent" and characterized the case against him in Manhattan as a continuation of the politically motivated charges and investigations that Democrats have leveled at Trump since he defeated Hillary Clinton in the 2016 election.

"From Russia, Russia, Russia, to the Mueller Hoax, to Impeachment Hoaxes 1 and 2, and even the Unlawful Mar-a-Lago Raid, Democrats have investigated and attacked President Trump since before he was elected – and they’ve failed every time," Trump spokesman Steven Cheung said.

"Now Democrats are at it again, pushing the 'Nuclear Button' and attacking a President because of a disgraced extortionist," Cheung added in reference to Stormy Daniels. "This is happening because President Trump is leading in the polls by a large margin against both Democrats and Republicans, and there’s never been anything so blatant in American political history."

I fully expect that this will go down for the same set of reasons that the Mar-a-Lago raid happened the way it did. The Leftist scumbags are grasping at whatever straws they think are within their reach to create the optics necessary to contest the shellacking they may receive should the benevolent gods of the Dominion Vote Counters of Plenty not be able to come to their aid in 2024.

They're negotiating, apparently. If the NY "officials" actually indict Trump (seems more than likely at this point), it's a state thing. NY will have to submit an extradition request to FL if Trump balks. If Trump doesn't balk and comes to NYC to address the indictment, chances are he flies back home to FL the same day after posting bond.

This apparently involves Trump's alleged payment to Stormy Daniels BEFORE HE WAS A CANDIDATE FOR PRESIDENT. But the NY critters believe he paid said "hush money" out of his campaign funds rather than his own personal accounts.

OK, let's say that Trump banged Daniels. Who does that hurt? Melania, evidently, because he was married to her at the time. Just like Slick Willie, who got blow jobs from Monica in the Oval Orifice, his infidelity allegedly "hurt" Hillary, who, as it turns out, couldn't care less as they have/had a so-called "open" relationship. Lots of Dems and proglodytes didn't give a shit about Slick's lying to the American people back in 1998. Why is a president who lies to the American people about an infidelity so f'n important now?

Oh, wait. I forgot. We're talking about the Donald. Never mind.

Another witness was supposed to testify so it’s interesting that Bragg’s office is the one who pulled the plug. Did something happen with the witness? Or does the DA’s office want to massage their case a bit more before making a final presentation to the grand jury?

Fox News claims via sources that there is dissension within the DA’s office on whether to move forward with the case, citing the weakness of the legal theory being proposed by prosecutors. That would make sense because it is indeed an incredibly weak play.

Still, I’d be skeptical that this is all collapsing in on itself. Bragg likely didn’t come this far just to close up shop at the first sign of trouble. Plus, if Trump ends up not getting indicted, it’s going to leave egg all over his face. It’s also going to hurt the credibility of the other cases being brought against the former president in various localities (and at the federal level), something that would no doubt leave left-wingers seething. Talk about a miscalculation if Bragg can’t even get an indictment in Manhattan.

For now, we continue to wait. Apparently, the grand jury is on “standby” to meet on Thursday. Will they or won’t they? The answer will be upon us soon enough.

Arama's afternoon writeup suggests that there's a lot of dissension in Bragg's office about the charges.

A grand jury does not look at the defense. It's strictly the prosecution and what they dream up say.

It would appear that Costello's testimony on Monday had an impact on the grand jury and the lawyers in Bragg's office.

OK, the drama from yesterday is over. Trump's perp walk was nothing more than a fleeting shot as he entered the room and another shot of him at the defendant's table. No cuffs, no orange jumpsuit, no clogs, no video inside the courtroom.

Ah, speaking of the courtroom and the judge. Lots of info about Juan Merchan, a rabid leftist Acting NY State Supreme Court justice who has contributed to SharterJoe's presidentish bid. And Merchan's daughter is the CEO of an organization that has pumped $250 million into leftist PACs and other cretinish swamps.

Like father, like daughter.

The way this is starting to look, Bragg will get his conviction. Merchan will see to it. Trump will appeal, and that's where this case will finally die. But not before a guilty verdict and subsequent sentencing.

No way in hell will Merchan grant the flurry of motions that Trump's team will present to him before the trial begins in December.

I just listened to Alan Dershowitz's podcast a few minutes ago. Everyone knows that Dershowitz is a confirmed, card-carrying Democrat (not a leftist). He has never voted for Trump and will never vote for Trump.

But in this 25 minute podcast (the rest of it Dershowitz talks about his mail and his crowd of worshipers), he talks about his legal analysis of Bragg's indictment. In a word, it's legal garbage. But he also says that in a city (Manhattan) which is comprised of 85% of the voters who absolutely hate Trump, he acknowledges that Bragg could get a conviction. Depends on the jury, of course, and if Dershowitz is correct, this could spell big problems for Trump.

If all of the motions for change of venue, case dismissal, and all of the other stuff that Trump's defense team will throw at the leftist judge fail, the trial will go on. And Trump could very well lose, which gives the leftists and Democrats around the country their ultimate victory -- Trump will be ineligible to run for office.

Say what you will about Dershowitz. He's beholden to the law. He also talks about how Caroline Kennedy, for one, told him that had she known he was invited to a dinner party, she would not have attended. That's the extent of her TDS, which then migrates to Dershowitz because Dershowitz had the temerity of arguing for Trump in, I believe it was the first impeachment trial. Her hatred of Trump is profound and he equates that hatred with the composition of the jury which will sit in judgment of Trump later this year.

If the alleged crime was federal, it would occur in the room in Trainor’s tweet. The FEC and DOJ prosecute campaign finance laws, not a local district attorney.

But then there’s Michael Cohen’s plea deal.

The document posted in Trainor’s tweet makes me wonder if officials regret that Cohen took the blame in his plea deal:

Before the Commission could consider the Office of General Counsel’s (“OGC”) recommendations in these matters, Mr. Cohen pleaded guilty to an eight-count criminal information,2 and in connection thereto admitted, among other things, to making an excessive contribution in violation of the Act by making the Clifford payment from his personal funds. The plea hearing transcript includes a step by step review of how U.S. District Judge William Pauley verified the plea, confirming that a federal judge was sufficiently satisfied with the circumstances surrounding the plea deal and the responses given by Cohen at the hearing, including the explanations given by Cohen, count by count, during his allocution.4 Ultimately Mr. Cohen was sentenced to three years in prison and ordered to pay $1.39 million in restitution, $500,000 in forfeiture, and $100,000 in fines for two campaign finance violations (including the payment at issue in these matters) and other charges. In sum, the public record is complete with respect to the conduct at issue in these complaints, and Mr. Cohen has been punished by the government of the United States for the conduct at issue in these matters.

“At the end of the day, there’s the person who committed the crime, and there’s the person who is behind bars because of it,” Trainor told The Washington Examiner.

The documents “in question came well after Trump’s 2016 election, so it couldn’t have been done to help his election.”

Trainor also said that nothing shows the payment and reimbursement happened to influence the 2016 election:

Third, it is not obvious that the reason for the payment and the reimbursement to Cohen was to influence the election, thus failing the “objective standard” of law. “It has to be something that anybody on the street can look at and say the only reason you did that was to influence the campaign,” said Trainor. “There’s a lot of reasons that he could have done it that aren’t related to him being a candidate for president, and so therefore, it wouldn’t have met the standard as campaign expenditure under federal law,” he added.

Statute of limitations:

Also, the statute of limitations on the case was running out, and it wasn’t worth the time and expense to prosecute, he said.

“I don’t know how you get around the evidence that both the Department of Justice in their investigation of the federal campaign finance issues and the Federal Election Commission in their ultimate jurisdiction over campaign finance issues, neither of them found there to be any violations whatsoever, and I think the jury is going to see that and they’re going to have to rely upon the fact that both the law enforcement experts and the civil enforcement experts, as far as campaign finance are concerned, didn’t find any violation of the law here,” said Trainor.

Bragg and the court cannot get around that evidence if they follow the rules.

If this happened, then Trump committed a misdemeanor. If it’s a misdemeanor that also means a two-year statute of limitations. To make it a felony, you must show that he committed this crime to cover up another crime. In this case, Bragg alleges that Trump falsified business records to cover up a campaign-finance crime.

The FEC Commissioner apparently didn't get the memo.

The memo states, in part: "Facts don't matter. Getting Trump convicted of ANYTHING matters. Trump shall not run for office any more."
