Makes sense, though, since if the intermediate court's decision stands his name gets struck and it can't be undone if the decision is reversed later, but if they either refuse the appeal or find against him at the IL Supreme Court, votes for him can always be thrown out later.

You really think that the issue is going to be adjudicated "justly" in Illinois??

No telling, Doc.  The IL Supreme Court has a lot more self-respect than Floriduh's, and although the IL State government has issues of its own, it is not part and parcel of the Chicago machine.

Supreme Court: Emanuel stays on ballot while his case is considered

The Illinois Supreme Court has ordered the Chicago Board of Election Commissioners to put Rahm Emanuel’s name back on the mayoral ballot.

The court has not decided whether to hear Emanuel’s appeal of Monday’s Illinois Appellate Court ruling that tossed him out of the race to replace Mayor Daley. But the Supreme Court granted Emanuel’s motion for a stay of the ruling.

“The appellate court decision is stayed,’’ the Supreme Court’s order reads. “The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago.’’

Can we say Rahm was "selected" by the Illinois Supreme Court?

I wouldn't go that far quite yet.  If they even decide to hear the case (likely), who knows what they'll rule?

BTW, a new poll just out:

While the Illinois Supreme Court prepares to weigh whether Rahm Emanuel's name should appear on the upcoming mayoral ballot, a new poll released Tuesday by the Chicago Retail Merchants Association (CRMA) shows Chicagoans have already made up their minds.

The third We Ask America poll conducted by the CRMA found that an overwhelming majority of Chicagoans think President Obama's former chief of staff should appear on the ballot. Nearly 72 percent of respondents say Emanuel's name should be a choice on the Feb. 22 mayoral ballot while 23 percent say it should not.

Assuming Emanuel's name does appear on the ballot, the poll found Emanuel favored by 52 percent of respondents, an increase of nearly 8 points since the December 20 poll. His closest rival, former school board president Gery Chico, garnered 14.4 percent while former Senator Carol Moseley-Braun received 11 percent. Emanuel's lead of 37.5 points is well outside the poll's margin of error of 2.05 points. About 16 percent of voters were uncertain who they would vote for, nearly unchanged since December.

If however, the court finds that Emanuel should not be included on the ballot, Chico's lead over Braun doubles. The poll found 33 percent of likely voters favored Chico with Braun earning 17 percent. The race would still be very competitive despite Chico's 16 point lead because 38 percent of voters remain undecided.

Miguel Del Valle, William "Dock" Walls and Patricia Van Pelt-Watkins all polled in the single digits in both polls.

The telephone poll of 2,308 likely registered voters was conducted on Monday, January 24.
