Title: Florida armed bystander stops gunman at crowded back-to-school event at park,

An armed bystander shot a man who opened fire at a Florida park filled with over 100 people -- including children -- for a Saturday back-to-school cookout, officials said.

The Titusville Police Department said in a news release the man was involved in a fistfight with another person at the Issac Campbell Park and left around 5:20 p.m. -- only to return with a gun minutes later and start shooting.

A bystander, who was lawfully licensed to carry a firearm, then shot the gunman.

“We are extremely grateful that nobody else was injured in this incident,” Deputy Chief Todd Hutchinson said in a statement. “This suspect opened fire at a crowded public park. This could have been so much worse.”

The gunman, whose firearm was recovered at the scene, was airlifted to a local hospital with life-threatening injuries. No one else was injured during the shootout.

I hope the concealed carrier has some sort of legal protection against the inevitable civil lawsuit.

He will most certainly be sued because the perp "has rights."  :whatever: The DA may not file charges, but that doesn't stop a civil lawsuit.

The "Stand Your Ground" law, immunizes you from criminal prosecution or civil suits if it is proven to be a good shoot.

No it doesn't.  It doesn't protect you from an over zealous DA prosecuting you anyway.

That's why it's important to have some kind of insurance from the NRA or USCCA.

As txradioguy says, no it doesn't.

But there is an added element to why the "Stand Your Ground" law doesn't apply to civil lawsuits. Before I even start with this, let me say I'm not a lawyer.

But I do have insurance and I have had some training in this area, applicable to my state (Arkansas) and where I once lived (Ohio).

First of all, the "Stand Your Ground" law, where applicable, applies to criminal law. You may be accosted by someone and threatened with deadly force and respond accordingly, killing or wounding the perp. The DA may conclude it's a clean shoot and that you were entirely within the law to defend yourself, meaning you won't be charged with a crime.

But that doesn't stop CIVIL lawsuits, where the burden of proof is much less pronounced, from being put on you. And those lawsuits can fine you tens of thousands of dollars, plus the legal fees. And if the civil lawsuit finds you culpable, you pay a lot of money to the perp's family that had the audacity to sue you to begin with. I was told in training in no uncertain terms that even in a clean shoot, you WILL be sued.

In our litigious society, that's what it comes down to and that's why I have insurance if I'm ever involved in a shooting incident.
