There's no such requirement in the COTUS. The president is CinC. Congress is the only one who can declare war but that doesn't mean the president is unable to issue orders to the troops. A DoW allows a president to bypass many matters ordinarily reserved exclusively to the legislature and judiciary.

The very nature of the statement is absurd on its face as non-state actors and internal insurgencies have been a threat since all of human history. You cannot declare war against a non-state or an insurgency as it is not a state power. The founders were well aware of this fact yet they had every expectation of federal troops being used to repel such threats.
