Congress has been adopting retroactive tax increases for a very long time, essentially since the 1930s. The 1913 Revenue Act was the first one with an effective date before the date of the actual enactment. Generally, the increased tax rate is applied retroactively to the year in which it is enacted. But in 1918 and 1926, each of the Revenue Acts was applied to the entire calendar year that had preceded enactment. As early as 1935, one commentator pronounced restrictions on retroactive taxation to be "dead."

These laws were bad in their own right. They were also bad because they paved the way for the retroactive imposition of many other forms of liability. Since the 1930s, the courts have tolerated such retroactive legislation. The Supreme Court has narrowly construed most of the traditional constitutional protections against retroactive laws. Many Americans mistakenly believe that retroactive legislation is barred by the ex post facto clauses, which apply to both Congress and state legislatures. Since at least the early part of the 1800s, though, the ex post facto clauses have been interpreted as applying to criminal laws only.

Numerous studies have shown that the fiscal cliff will take our anemic 1.3% growth (if you can believe it being that high) to a recessionary -.5%. Ask voters if they want to vote for a man who will WILLINGLY and KNOWINGLY cause serious damage to the already weak economy just to get his way, and if they're ready to pay the consequences of his spite.

This could end up costing him a few votes in swing states and the dems some HOR and Senate seats.

When Clinton passed the biggest tax increase in history he did it retroactively to January 1st of that year.  I know for a fact because that was the biggest single earning year in my life and the retroactive part cost me many thousands of dollars.

Congress can do whatever they want. Repeal the Obamacare and make the Bush tax cuts permananent retroactive to 1/1/2013.

Dunno about that, for most Federal employees (Which includes military) the income tax withholding would mean they're just screwing themselves since the IRS gets the money all year, generally more than they're due, so the IRS ends up with everything that went in without having to cough up any refunds.  The only way to beat it is to claim a shitload of dependents.  The primary offenders I encountered for just blowing off the whole tax filing thing were junior enlisted personnel, and they were only screwing themselves, not the IRS.

Read the article I linked to, sir.  We may not like it most of the time, but the USSC has been interpreting the ban on ex post facto laws in a strictly limited, criminal law sense since about 1935.
