I thought it was nothing but misdemeanors in NY?
Saw it right here again and again.

Actually 34 felonies it looks like.

Looks like they are trying to enhance a misdemeanor by trying to tie it to committed in order to commit another crime.  The other crime? Not listed or charged...

 :thatsright:

DUmpmonkiez too stupid to realize the DA seriously ****ed up...

9. Some misdemeanors are elevated to felonies when committed

in aid of another crime.

SECTION 175.10
Falsifying business records in the first degree

Penal (PEN) CHAPTER 40, PART 3, TITLE K, ARTICLE 175
§ 175.10 Falsifying business records in the first degree.

A person is guilty of falsifying business records in the first degree
when he commits the crime of falsifying business records in the second
degree, and when his intent to defraud includes an intent to commit
another crime or to aid or conceal the commission thereof.

Falsifying business records in the first degree is a class E felony.

What crime is he accused of committing? Bragg doesn't say...

SECTION 175.05
Falsifying business records in the second degree

Penal (PEN) CHAPTER 40, PART 3, TITLE K, ARTICLE 175
§ 175.05 Falsifying business records in the second degree.

A person is guilty of falsifying business records in the second degree
when, with intent to defraud, he:

1. Makes or causes a false entry in the business records of an
enterprise; or

2. Alters, erases, obliterates, deletes, removes or destroys a true
entry in the business records of an enterprise; or

3. Omits to make a true entry in the business records of an enterprise
in violation of a duty to do so which he knows to be imposed upon him by
law or by the nature of his position; or

4. Prevents the making of a true entry or causes the omission thereof
in the business records of an enterprise.

Falsifying business records in the second degree is a class A
misdemeanor.

 :whatever:

Manhattan District Attorney Alvin Bragg said at a news conference after the court hearing that the alleged scheme was intended to cover up violations of New York election law, which makes it a crime to conspire to illegally promote a candidate. Bragg also said the $130,000 payment exceeded the federal campaign contribution cap.

Under New York law, most nonviolent felonies must be charged within five years of the alleged misconduct. But legal experts say the statute-of-limitations clock could be paused under certain circumstances, including during the period in which a defendant moves out of the state.

14. We don't know if he'll be tried on all these charges, am I right?

I believe the DA is allowed to decide which charges are the ones to go after at trial. Some might be tried later, some might be dropped, maybe a plea deal is being discussed. I think the DA has some leeway here.

The are all the same charge, cut and pasted, with the dates changed...

17. Most of the reports I read expected it to be a felony.

The underlying falsifying records charge is a misdemeanor but it was widely expected that it was going to be tied to other crimes to make it a felony.

What other crime?

Trump's legal team is going to eat Bragg for breakfast.
