Under the law he HAS to be charged this way. He's an American citizen and under the Military Comissions Act that was passed shortly after we started the WoT he has to be charged this way.
Thank the Dems back in IIRC 2003 for forcing this crap on us and the Bush Admin for caving and going along.
ETA: The best we could hope for now is for the prosecution to revoke his citizenship based on what he did...THEN he could get his one way ticket to Gitmo.

Just because the FBI liked pumping him and were getting information from him, it doesn't mean the info they were getting really qualified for the whole Miranda exclusion thing, the DOJ was right to cut its risk so eager-beaver FBI interrogators wouldn't FUBAR the whole criminal case. Smells a bit overcooked.

It's my understanding the FBI was to have "48 hours" to interrogate but was cut short to 16 hours.
It's also my understanding there is more than enough evidence without any info from the suspect to convict him.
I suspect WH interference.

Completely blindsided from the sounds of it:

He was singing like a bird when this Judge showed up and did the miranda thing. The FBI was furious about it too.
It's probably all these stupid PC directives that caused this disaster in the first place. We are in worse shape now than before 911 with this bunch in office.

They are kind of mixing and matching two different rules in their whining, one being the emergency exception ('Where's the gun?' questions) which has been tested in court but is limited to a very specific, urgent, immediate, and obvious threat to public safety, and the other being a 'National security exception' which hasn't stood the same scrutiny ("Tell us everything you know about terrorism, everything you have ever had to do with it in your life, what books did you read on it, where did you get them, who are all the people in your email contacts and phone, do you like chocolate, and did you ever pick your toes in Poughkeepsie? Don't leave out any details..." fishing expedition questions). I expect it was clear pretty early on that he didn't have a Hell of a lot to add on the first one, or much of anything of serious and immediate value (Although no doubt of 'Some' further intel value) on the second, and the US Attorney decided to pull the plug on the fishing trip. Of course the US Attorney may decide to throw one of the deputy or associate attorneys to the lions with enough blowback over it.
The way the whole 'Fruit of the poisonous tree' stuff works with unwarned interrogations is a lot more complicated than just the suspect's own admissions, any evidence that the interrogation leads to even collaterally can be tainted and therefore prohibited; the government can try arguing they would have figured it out anyway, but it sets up an evidentiary battle where the presumptions generally run against the prosecution.

Question from a totally confused female with zero knowledge of the workings of the FBI, CIA, or terrorism in general.
How on earth can anyone believe one word that anyone says when caught doing EVIL ????
So the kid says they were headed for NYC, why believe he is telling the truth, they may in fact been headed for the docks in Boston to blow up the USS CONSTUTION and disrupt shipping to the docks.
The reason for 48 hours to interagate a suspect is to catch them in lies and inconsistency. This kid has nothing to loose now so why tell the truth about any darn thing.
Facing life in Prison, he may as well have some fun and lots of visitors by sending investigators on wild goose chases. Let everyone believe he has more knowledge then he has and make them believe his lies.
This kid has more to loose by telling the truth then he will by lying.
Seems they had just one more bomb on them when they fled, this came apart when thrown from the car. Anything done with that bomb would be anti climatic after the damage done with the two they set off.
Then there is the boat he was found in, some law enforcement say he was found with no weapons, yet
clear as day the sounds of gunfire are heard on recorders from the Public.
Why is everyone so willing to believe anything he or the government says ??????????

BS me if you must, but I'm one of those who believes that an American citizen has his 5th Amendment rights whether or not a "Miranda" statement has been read to him*. Authorities feeling the need for certain information may, IMHO, attempt to provide their captive with credible assurance that such information will not be used against him.
In the unlikely event I am questioned by police, it is my intent to quote the Miranda statement to them, substituting "I" and "my" for "you" and "your", followed up for a demand for a black coffee, a bottled water, and a lawyer, in that order, and all within 15 minutes.
*In much the same way as I believe an American citizen has his 2nd Amendment right to buy a Thompson from a hardware store without notice by, let alone permission from, the State.

Nope. Two men planning to set off anything anywhere is of mere academic interest when one is dead and the other injured and under guard in hospital, and their bombs expended or disarmed in the course of pursuit and capture.
Now if he told them there were two other men out there headed for NYC, that would be "serious or of immediate value".

We'll probably never know if there were others. What was leaked so far, the FBI said that they were getting a lot of valuable information. And that was according to several congressmen who sat in on a closed security meeting.
As far as him getting his miranda rights and then told to shut up, I have a problem with someone becoming a citizen for only six months before commiting terrorist acts on our citizens. Supposedly this guy was vetted prior to citizenship. Apparently that vetting does not take into consideration that he had a brother with an FBI and a CIA file, not to mention being notified by Russia to investigate him, and having a mother who fled the country to avoid prosecution.
A whole heck of a lot of people didn't do their do dilligence, and again we are a laughing stock for other wanna be terrorists who want to murder us.
