 I'd say that Utah probably set their BAC at .05, as at that level, nystagmus typically occurs around 45 degrees.   

Brush up on SFSTs and HGNs,  what law enforcement are looking for in said sobriety tests, and then ask yourself if you want a person who fails these basic tests out driving among the general population.   I'd say that Utah probably set their BAC at .05, as at that level, nystagmus typically occurs around 45 degrees.   

I happen to believe DUI laws are common sense laws for those that don't possess any common sense themselves.  You can always buy a handheld breathalyzer, which are reasonably accurate at telling you when you shouldn't be driving.  Or just cut out the middleman, and take a cab.

I can't say I agree totally with DUI checkpoints, as I don't believe them to be very effective.  Perhaps as a deterrent, maybe.
