Weiner v. Breitbart -- US Supreme Court
Edited on Thu Jun-09-11 05:40 AM by kentuck
Griswold v. Connecticut, 1965, protected the individual's right to privacy. Roe v. Wade came later. It is an established law.

Personally, I think Anthony Weiner needs to take this case to the courts. It would be a precedent in the technology era. If you send someone a private photo, pornographic or whatever, does someone else have a right to get that photo and put it all over the Internet and the world? Unless this individual was CC'ed the photo, then he would have no claim to it. He would have no right to disseminate the photo and to humiliate or destroy the life of the other individual.

With that said, I think Weiner's career is possibly over. His political life, and perhaps his personal life, is ruined. It is not relevant whether or not he sent pornographic photos of himself to women or not? The question is whether or not Mr Breitbart had the right to intercept or to attain those photos and put them out for everyone to see? I think the law would say that he does not and that he should be held accountable, both monetarily and criminally.

I think Congressman Weiner should take this all the way to the Supreme Court. It is not about whether he was right or wrong in his actions. It is about his right to privacy.

5. I realize that but..
I still think there are privacy issues here that need to be addressed by the Court. How did Breitbart get the photos?

6. once weiner sent those pictures to another person, they could do whatever they wanted with them.
they could have posted them all over hell with his name right on them if they wanted to and he couldn't have done anything about it. they could have sold them to the tabloids. if breitbart hacked into his computer to access the pictures, that might be a different matter, but if he and his minions were stalking weiner's twitter followers, then i'd bet they got access that way. if that is the case then weiner has no recourse.

Is there a right to show a "private" photo to whomever you wish if it was sent to "you"?

No matter how many DUmmies have a moment of semi rationality kentuck insists Weiner should sue.

Many, many paragraphs and you check a little box that you agree with the terms. They have no idea of your mental capacity or anything else. I would question their legality also.

Only a complete IDIOT would question if it was illegal.

The answer is yes.  So, don't send naked pictures of yourself to people.  Actions have consequences.  Why is that such a difficult life lesson for so many people?

Just think about how stupid and incompetent Weiner is, and even he's got enough brain cells left to know not to even consider taking it to court claiming privacy.  Now consider that the bluegrass primitive believes there's a case to be made for invasion of privacy making him even more stupid than Weiner.  The bluegrass primitive is extremely stupid, and that's an gross understatement.

It sounds like Kentuck may have gotten one of those evil mortgages, too.  You know, the ones where those evil bankers put thousands of pages of papers in front of you and forcibly make you sign your name to a mortgage with an adjustable rate?

Kentuck is an excellent example of why these people should not be allowed to reproduce.  How dare they be expected to read, agree to, and sign contracts or agree to TOS for websites?

The Supreme Court.   :lmao:
Don't laugh too hard. If the muslim gets a second term, we may end up with a Supreme Court with six or seven raving moonbats. Things that sound crazy to us today could become the law of the land. That's why a Republican win is far more important than whose name is on the ballot. Anything else can be corrected by one election, but the Supreme Court can take generations.

A person who was truly intellectually incapable of understanding a basic contract might have a leg to stand on when it comes to the check box signature on an internet contract.  I'm assuming that Representative Weiner is intelligent enough to understand written English, so I don't think he gets a pass on this one.

Maybe we could try this: the taxpayers of Kentucky agree to send the bluegrass primitive a welfare check every month.

But then they don't do it, and using the bluegrass primitive's logic and reasoning, that's okay.

If you row over, be sure to take plenty of stupid repellent.  The other DUmmies try to reason kentuck out of his thinking, but he just keeps coming and coming and coming.  I can't believe he alighted on the position that Weiner should walk into court and whine that he was too stupid to understand a TOS.  That should just catapult his career!

I'm still a bit concerned that BattleHymn would use "Weiner" and "box" in the same sentence. :fuelfire:

John Adams warned in a letter, “Remember democracy never lasts long. It soon wastes, exhausts, and murders itself. There never was a democracy yet, that did not commit suicide.”

Do you not listen to any of the advice that is given to the pre-teens and teenagers who "sext"?  They do what Weiner did.  Take provocative pictures and send them to their "boyfriends".  When the boyfriend gets a hold of the pictures, he then sends them to his friends.  His friends send them to their friends.  And it goes on and on and on.

Use your better judgement before sending pictures revealing more than you'd want your grandma to see.

Oh my.

I have no idea the sender of this; it's obviously been sent using a junk e-mail address.

I know, I know, one could probably "track back" an address, but I don't mess with it.....and besides, life is so much more interesting when one is compelled to figure out things, rather than it being known up front.

This surely puts a new unanticipated twist into the script, something not even the nadinostradamus primitive could have foretold.

This could be from my fellow alum Skins, or worse--worse beyond one's capacity to fathom--Fat Che, or it could be a bona fide offer from a member of the DUmpster here.

I'll consult with my spirit guide about it later; not now, as I've got things in real life to do this morning.
