After Deliberating For Three Minutes, Florida Senate Panel Approves Anti-Sharia Bill

A Florida Senate panel approved a measure to ban the use of Sharia law in the Sunshine State yesterday after deliberating for just three minutes and turning dozens away who sought to give their testimony.

SB 1360, which already passed the Senate Judiciary Committee, was approved by the Criminal and Civil Justice Appropriations Subcommittee on Tuesday by a 5-2 vote. A concurrent anti-Sharia bill in the House was also sent out of committee last week and will be voted receive a floor vote in the next few days.

The proposed legislation, which would ban the use of “foreign law,” is drawing ire not only because it’s been used as a way to attack Muslims in this country, but also because it could have a number of unintended consequences. As the Orlando Sun-Sentinel notes, many Jewish groups are calling the legislation discriminatory against them as well:

Impairing the free expression of religion.

Not only would Sharia Law be banned, so would the religious law of other religions. As per the article, rabbis could no longer grant or deny gets and the Catholic Church could no longer grant annulments. And if the proposed law were drafted to only outlaw Sharia Law, then there would be a problem with the Equal Protection Clause in the Fourteenth Amendment of the Federal Constitution with treating one religion differently from other religions.

Umm, who wants any Biblical references removed from any and all public areas?

It's religious law that is interpreted in various ways.

Ironically, I was just reading a very good article on this subject. A small percentage of the Islamic population in Australia is calling for recognition of sharia there, as well. The author of the article makes some very good points regarding why this "dual legal system" simply could not work in Australia, and I think his reasoning easily applies to us, as well.

Do we already formally recognize any other religious law in our courts? How could a legal system even attempt to apply to everyone equally if there is recognition of a different set of laws applying to one religious group? And if one, then why not another?

A: Birth Control is prohibited in Islam, for more than a reason. It is an established fact that one of the objectives of marriage, as per Shariah, is to produce and preserve the human race. A tradition of the Holy Prophet (saws) says, "Marry the woman who loves you most and who is fertile". (Abu Dawood, Nasai)

And, it is not permissible to undermine this object, because it goes against the object, which has been given most significance in Islamic Shariah.

Birth control is, usually, adopted for the fear of poverty, and it indicates to the lack of trust in Allah, whereas, He says in the Holy Qur'an:

"And there is no creature on the earth whose sustenance is not on Allah." (11:6)

It is obvious from the above verses that Allah (swt) has taken on Himself the responsibility of providing the sustenance for the creatures including all human beings. So, the one who adopts the birth control, he has no trust in this verse of the Holy Qur'an and in Allah. The Qur'an says,

"And do not kill your children for the fear of poverty." (17:31)

This statement of the Holy Qur'an has prohibited the killing of children for the fear of poverty. During the period of ignorance, some people used to kill their children at birth in fear of having to face the expenses on their maintenance. In the above verse, it has been mentioned that the killing of children for the fear of poverty is also an act of ignorance, because they do not know that the responsibility of the sustenance is on Allah alone. From this view point the Holy Qur'an has shed light on the above issue also, because this is based on the same false assumption that the parents and the guardians are the ones who are responsible, not Allah alone, for sustenance of their offspring. Although this may be not a sin equal in gravity to that of the killing of children, but there is no doubt, it is blame worthy. In short, the birth control system is impermissible in the Shariah. Here, I am going to quote the Fatwa issued by the Fiqh Council during its fifth conference, held in Kuwait. It says:

"It is not permissible to issue laws that limit the freedom of couples to have children. It is haram to remove the ability of men and women to have children, which is known as sterilization, so long as there is no need to do so, according to Shariah principles. It is permissible to use temporary means of contraception in order to increase the gap between pregnancies, or to stop them for a limited period of time. If there is a valid Shariah (lawful) reason for doing so, based on the couples estimation and with mutual consultation and agreement, subject to the condition that these do not result in harm and that the means are acceptable according to Shariah and will not damage any existing pregnancy". (Majallat-al-Majmah 1:73)

I'm perfectly OK with that...Talmudic law has no more place in our legal system than Sharia, nor does Vedic, the Code Napoleon, Yoruban tribal law, Teutonic inheritance practices, or the Code of Hammurabi.  In a given situation any of them might be relevant to understand the facts, but none of them have any business influencing the outcome on the legal issues.

My 2 cents on this Sharia law crap. If it succeeds anywhere, it will be imposed in the liberal states first. I just hope they kill all the dummies and other assorted worthless parasites, or at least make their life more miserable than it already is, before it's gets beat back by the conservatives in the red states.
