Armed St. Louis protesters broke iron gate, threatened couple before they drew their own guns, attorney says

A Missouri couple under fire for brandishing guns in the front yard of their home as protesters passed told police the group broke a gate to get onto the private street, and the pair say they only retrieved their firearms when they spotted “multiple” people who were already armed, department records show.

Al Watkins, an attorney for Mark McCloskey, 63, and his 61-year-old wife, Patricia, said the protest was largely peaceful and the pair did not bring their guns outside of the home until two men in particular, both of whom were white, started menacing them.

The McCloskeys, he said, were hesitant to come forward with the full story out of fear that they would "disparage the importance of Black Lives Matter."

What really happened.

Quote
The pair called the St. Louis Police Department shortly before 7:30 p.m. Sunday. They told arriving officers that they had heard a "commotion" and, upon investigating further, “observed a large group of subjects forcefully break an iron gate marked with ‘No Trespassing’ and ‘Private Street' signs.” according to an incident summary provided to Fox News by the department.

The police report does not identify the McCloskeys as the victims.

“Once through the gate, the victims advised the group that they were on a private street and trespassing and told them to leave,” the police summary further states. “The group began yelling obscenities and threats of harm to both victims. When the victims observed multiple subjects who were armed, they then armed themselves and contacted police.”

Based on the couple’s account, police labeled the incident a case of trespassing and assault by intimidation, according to the incident summary. No other police reports were filed that night, a department spokesperson told Fox News.

St. Louis prosecutor ordered crime lab to reassemble Patricia McCloskey's gun
https://www.ksdk.com/article/news/local/gardner-staffer-ordered-crime-lab-to-reassemble-patricia-mccloskeys-gun/63-be112149-d06c-4f54-a225-6545e74b5c2d?

Quote
ST. LOUIS — The gun Patricia McCloskey waved at protesters was inoperable when it arrived at the St. Louis police crime lab, but a member of Circuit Attorney Kim Gardner's staff ordered crime lab experts to disassemble and reassemble it and wrote that it was “readily capable of lethal use” in charging documents filed Monday, 5 On Your Side has learned.

In Missouri, police and prosecutors must prove that a weapon is “readily” capable of lethal use when it is used in the type of crime with which the McCloskeys have been charged.

Assistant Circuit Attorney Chris Hinckley ordered crime lab staff members to field strip the handgun and found it had been assembled incorrectly. Specifically, the firing pin spring was put in front of the firing pin, which was backward, and made the gun incapable of firing, according to documents obtained by 5 On Your Side.

Firearms experts then put the gun back together in the correct order and test-fired it, finding that it worked, according to the documents.

Evidence has been altered.

Quote
“It’s disheartening to learn that a law enforcement agency altered evidence in order to prosecute an innocent member of the community,” Schwartz said.

A spokeswoman for Gardner wrote: "We can't comment on a pending case."

There is no reference to the operating condition of the gun in the probable cause statement police wrote on the case. The only reference to it is contained in the charging document with Hinckley’s name on it.

9 BLM protesters cited for trespassing in St. Louis, McCloskey suspects 'there won’t be any charges’
https://www.foxnews.com/us/nine-blm-protesters-cited-for-trespassing-on-st-louis-property-mccloskey-suspects-there-wont-be-any-charges

Quote
Nine Black Lives Matter protesters in St. Louis were cited for trespassing on the property of Mark and Patricia McCloskey after the armed couple defended their home from a crowd of nearly 500 people, they told “Fox & Friends Weekend.”

St. Louis Circuit Attorney Kim Gardner charged the couple with the felony of unlawful use of weapons for pointing guns at protesters back in June, but Patricia McCloskey said the protesters being cited most likely will not be charged with anything.

“These are just tickets, they’re municipal type tickets,” she said. “Nine of three to five hundred people, I don't know how they chose those nine people…. I suspect there won't be any charges even for these nine people.”

Just tickets. They should be sent to the Supermax.

Reflecting on this weekend’s shooting of two deputies in Compton, Calif., Mark McCloskey pointed out that the government continues to allow and even encourage protest violence.

“The mob outside my house was chanting, ‘You can't stop the revolution,’” he said. “What's the definition of a revolution? The violent overthrow of government. And do we see that happening all over the country? And who's stopping it? The Democrat-run cities, they're encouraging it… They're asking the public to engage in violence and stuff like this happens. This isn't a coincidence.”

The left is encouraging black people to act out without consequences, thus making them even more emboldened and reckless. There will be blood spilled between the races very soon and it will be the fault of the Democrats.

Gun-waving St. Louis couple indicted on weapons and evidence-tampering charges
https://www.axios.com/st-louis-couple-weapons-evidence-tampering-c7998ee8-dc23-4876-9d2b-6590bf1fcb75.html

Quote
A grand jury in St. Louis Tuesday indicted a couple on charges of unlawful use of a weapon and tampering with evidence on Tuesday, more than three months after they confronted anti-racism protesters marching by their mansion with guns, according to the St. Louis Post-Dispatch.

Why it matters: Mark and Patricia McCloskey, both attorneys, became heroes in conservative circles after the event went viral. They were invited to speak and endorse President Trump at the Republican National Convention in August.

Missouri Gov. Mike Parson (R) has already said he will pardon the couple if they are convicted.

Mark and Patricia McCloskey should never be charged.

Quote
What's next: Joel Schwartz, the McCloskeys' attorney, said he plans to request a transcript or recording of the grand jury's proceedings if such records were kept.

From what I read, the prosecutors tampered with evidence. The handgun the woman had was not in operable condition until after the investigators fixed it.

correct. And yet the leftist prosecutor has the audacity of charging the McCloskeys for the same crime -- evidence tampering.

I'm sure Soros is proud.

St. Louis Prosecutor Removed From Mark McCloskey Case
https://www.newsmax.com/us/mark-mccloskey-patricia-mccloskey-black-lives-matter/2020/12/11/id/1001064/

Quote
St. Louis Circuit Attorney Kim Gardner and her whole staff have been removed from the case against Mark McCloskey, who with his wife Patricia was charged with brandishing weapons against Black Lives Matter protesters earlier this year, after the prosecutor referred to the case in her fundraising emails.

The decision doesn't apply to McCloskey's wife but means that a special prosecutor will have to take over the Mark McCloskey case, reports NPR.

Circuit Judge Thomas Clark II said Gardner's emails "raise the appearance of impropriety and jeopardize the defendant's right to a fair trial," according to The Associated Press.

Patricia McCloskey is scheduled to appear before a different judge on Jan. 15.

Kim Gardner has been removed from the case.

Quote
Gardner, St. Louis's first Black circuit attorney, claims the emails used the McCloskey case as a self-defense move against conservative politicians and media. One email said she was under "national scrutiny from our divisive President, the Republican establishment of Missouri, and the right-wing media, including Fox News."

In his ruling, Clark said Gardner has "every right to rebut criticism, but it appears unnecessary to stigmatize defendant – or even mention him – in campaign solicitations, especially when she purports to be responding to others."

Investigation finds massive wrongdoing by prosecutor in case against ex-Missouri governor
https://justthenews.com/accountability/political-ethics/investigation-finds-massive-wrongdoing-prosecution-against-ex

Quote
Missouri's chief legal disciplinary officer accused St. Louis' top prosecutor of sweeping misconduct in the failed prosecution of former Gov. Eric Greitens, saying she lied to judges in court filings and testimony, withheld exculpatory evidence from the defense, misled her own prosecution team and violated the constitutional right to a fair trial.

St. Louis Circuit Attorney Kimberly Gardner, one of the early local prosecutors bankrolled by liberal megadonor George Soros since 2016, engaged in 62 acts of misconduct that resulted in 79 false representations during Greitens' now-dismissed criminal prosecution, according to Chief Disciplinary Counsel Alan Pratzel's memo obtained Wednesday by Just the News.

"Probable cause exists to believe that the respondent is guilty of professional misconduct," Pratzel declared in a 73-page memo that repeatedly accused Gardner of withholding evidence of innocence and providing a false portrait to the courts, the defense and even her own prosecution team.

Kimberly Gardner could loser her law license.

Quote
Pratzel's memo, however, provides the most direct and serious threat to her hold on the St. Louis prosecutor's office. Disciplinary action, if upheld by a hearing panel and the Missouri Supreme Court, could range from public admonishment to loss of her law license, the latter of which could end her tenure as circuit attorney.

The disciplinary memo cited a litany of violations of rules designed to ensure ethical behavior by lawyers and prosecutors, and fair trials for defendants. It alleged she made false statements in court filings, engaged in "conduct prejudicial to the administration of justice" and harmed Greitens' right to a fair trial by keeping required evidence of innocence from the defense.

Gardner violated "the rules of criminal procedure and court orders by concealing discoverable and exculpatory evidence," the memo stated.
