Donald Trump's supporters have demanded Kathy Griffin be arrested after she was seen holding up the president's 'head' in an outrageous stunt.



Outspoken comedian Griffin was seen slowly raising Trump's head during a photoshoot with infamous photographer Tyler Shields.

'Tyler and I are not afraid to make images that make noise,' Griffin said during the shoot, videos for which appeared on Shields' official website.

But, in Griffin's case, there is no question the photo of her holding a mock Trump head is protected speech, said Stanford University Law Professor Nathaniel Persily.

The photograph did not directly threaten the president and it didn't urge other people to harm him, Persily said.

"People are allowed to wish the president dead," up to the point they express a real intent to harm him, Persily said. "To threaten someone you need words that encourage some sort of action," and those words are absent in Griffin's photo, he said.

My response to Kathy Griffin’s recent tasteless, terrible, offensive photo of President Trump was immediate and visceral. The comedian, who was seen holding a prop of Trump’s bloody head, deserved to be called out in only the strongest of terms, and I was glad to see people from all political sides quickly taking to social media to join that call.

Like clockwork, Griffin issued an apology, and like clockwork, I clicked on the video expecting to roll my eyes at a celebrity clearly carrying out her agent’s wishes.

But I was taken back by what I saw — a genuine apology. “I crossed the line.” “I went way too far.” “The image is too disturbing.” “I ask your forgiveness.” “I beg for your forgiveness.”
