I also heard a lawyer on FOX just say that the Supreme Court decided back in '05, that kids 18 and under couldn't face the death penalty. If they are charged with first degree, proving that it was premeditated may be a problem.
Kimberly Guilfoyle, a former prosecuter in CA, on The Five yesterday said, no one under 18 committing a murder, could be given death penalty. Doesn't matter the circumstances.
Premeditated has nothing to do with weapon used or how person was killed. It only means the murder was planned prior to committing.
The fact they randomly picked this poor guy, may have some influence, but I doubt it. They set out to murder someone, anyone...and that should be all that matters.
