I don't see how Walmart could have been negligent in this.
Walmart is absolutely negligent for this. They had a sign posted outside that stated "blitz line starts here." It was also their dance, so they are more than liable for ensuring the safety of customers on their property.
I loathe Walmart, and find most of these stores to be dirty, disorganized, and just plain disgusting (not all of them, but far too many of them around here). I did however stand in line at one this morning at 4:30 a.m. (a clean super Walmart closer to Boston) as I love Black Friday shopping and have been enjoying it with my sisters and friends for many many years. One of my sisters had a list of stuff she wanted to get at the Walmart doorbuster price so we went there first. The line extended from the front of the building all the way to the back of the building. The crowd was very festive and friendly -- as has been the case at most stores every year I go out, and when the doors opened the line moved into the building in a very orderly manner. The Walmart staff handled the crowds perfectly -- no problems at all.
I ended up getting my husband a blue ray dvd player, my son a portable dvd player, and a toy for my twins that is sold out everywhere (Playskool Dance Cam), so it was all good forcing myself to go to Walmart.
Black Friday shopping is a lot of fun. Morons like this don't define the shopping experience -- especially given the area of Long Island this happened in. The security should have been heightened from that alone.
Walmart is paying big for this, as they should.
