NEWARK, N.J. (AP) - Opponents of the Iraq war say former President George W. Bush overstepped his authority when the U.S. invaded Iraq in 2003.

A veteran and two mothers of soldiers are trying to get the war declared unconstitutional. Their attorneys made arguments Tuesday in federal court in Newark, N.J.

They cited Justice Antonin Scalia's strict interpretation of the Constitution in a decision last year that affirmed the right of homeowners to own guns for self-defense.

They argued that Bush overstepped his constitutional authority to invade Iraq without Congress officially declaring war. They say that wasn't the intent of the Founding Fathers.

The government argued that courts do not have authority to rule on a political matter.

What are they gonna do...impeach all of Congress?   :whatever:  Besides, it's Uncle Zer0's war now.   :fuelfire:

Stupid people make lawyers rich.  As a lawyer, I think that's a good thing, the stupid people would just misuse the money anyway.

I could see this making it through the courts on appeal all the way to the USSC.

The judge needs to be jailed for not throwing this silliness out the minute it was brought to his attention.  He has no authority over the issue.  This judge is stealing from public coffers.

This case or any other witch hunt case against Bush or the Iraq war will go nowhere. Why? Because if it does go forward it will become a media attraction and will be so candid during testimony (unless they plan to destroy 8 yrs of congressional records), there will be no way to hide the overwhelming  DEMOCRAT support for the war and other policies installed post 9/11, the very policies the demwitted left rail against non stop. This current movement to the far left was started on a much bigger lie and cover up by the dem. party, and when they are through bringing it to light in open court, Bush will look like a boy scout.

OEF was also given congressional blessings as an AUMF, why aren't they going after that war? Too politically hot?

What next? Gonna sue Jefferson for taking on the Barbary pirates? Why not sue Obama for the Somali pirates?
