Biden Moves to Block Release of 70 Hours of Audio Recordings With Ghostwriter

Former President Joe Biden plans to go to court to block the Trump administration from releasing roughly 70 hours of partially redacted audio recordings of his conversations with a ghostwriter, the Justice Department said in new court filings Friday.

DOJ attorneys told U.S. District Judge Dabney Friedrich that they expected Biden to seek to “prevent any such disclosures” of the recordings to both Congress and the conservative Heritage Foundation, which filed a Freedom of Information Act lawsuit to access the materials. The Justice Department set a Tuesday deadline for Biden to file legal action and agreed to hold off on any release until June 15 if he does.

A spokesperson for Biden confirmed Sunday that the former president plans to fight the release.

“President Biden cooperated fully with Special Counsel Hur, and agreed to provide audiotapes of conversations with his biographer for a book about his deceased son on the condition that they would not be made public,” spokesperson TJ Ducklo said in a statement. “The DOJ themselves have said these tapes serve no public interest.”

What the Audio Is, and Why It Matters
The recordings were gathered by investigators working for Special Counsel Robert Hur, who was appointed by then-Attorney General Merrick Garland in January 2023 to investigate Biden’s handling of classified materials. The probe began after documents turned up at a University of Pennsylvania think tank Biden had been affiliated with post-vice presidency, and later at his Delaware home.

The recordings DOJ now seeks to release reportedly include sessions in which Biden read aloud from notebooks that officials later determined contained classified entries. According to exchanges cited in Hur’s report, the audio also captures Biden telling Zwonitzer, “I just found all the classified stuff downstairs.”

Biden has repeatedly contested that characterization. “I did not share classified information,” he said in February 2024. “Guarantee you, I did not.”

The recordings and transcripts DOJ plans to make public are expected to be edited for privacy purposes and to remove any underlying classified information before release.

Ghostwriter Attempted to Delete the Recordings
Zwonitzer did not simply hand the recordings over. According to Hur’s report, he moved audio files into his computer’s recycle bin after learning that a special counsel had been appointed. Investigators recovered the recordings, and Zwonitzer was later granted immunity by prosecutors in exchange for his cooperation.

Former President Joe Biden on Friday abandoned his legal fight to keep audio recordings and transcripts of his memoir interviews out of Republican hands, ending the case in Washington federal court days after a divided D.C. Circuit panel cleared the way for release to the House Judiciary Committee and the conservative Heritage Foundation.

The dismissal closes out a monthslong effort to shield roughly 70 hours of conversations Biden held with ghostwriter Mark Zwonitzer at his Delaware home in 2016 and 2017 while preparing his memoir "Promise Me, Dad."

Special Counsel Robert Hur obtained the recordings during his investigation into Biden's handling of classified documents and drew on them in declining to bring charges.

Joe Biden fought like hell to keep a set of audio recordings with his ghostwriter locked away.

He lost.

After a two-year legal battle, those tapes are now public, reviving questions about Biden's handling of classified information and raising fresh questions about his cognitive decline. The recordings run roughly 70 hours long, so there’s a lot to go over.

Special Counsel Robert Hur cited these very recordings in his February 2024 report on Biden's handling of classified documents, which detailed how Biden kept volumes of notes at his home, some of it classified material he had no business holding onto. Biden made the tapes while working with ghostwriter Mark Zwonitzer on his 2017 memoir Promise Me, Dad: A Year of Hope, Hardship, and Purpose. While the classified material never made it into the published book, the sharing of classified material is the issue here.

When the Hur report dropped, Biden told reporters, "I did not share classified information. I did not share it with my ghostwriter," claiming he had no idea how boxes of classified documents ended up in his garage.

The tapes tell a different story.

"Some of this may be classified … So, be careful. I'm not sure ... It's not marked classified but…” Biden told Zwonitzer on tape. Moments later, Biden said, "The next thing I have here is, um, this is classified …"

So Biden not only shared classified information, but he also knew he was doing so.

1. LIEden illegally shared classified information he could not legally possess knowingly.

2. Despite the fact that LIEden knew this, Hur declined to prosecute for, IMO, a flimsy reason.

3. Jack Smith was shamvestigating Trump for possessing classified documents he could, as President, legally possess and was negotiating with the National Archives - in bad faith on the part of the Archives - for a handover dividing personal effects from documents that should be transferred to the National Archives. The head of the National Archives was coordinating with LIEden's plan to raid MaL.
