“jury of peers” slowly dies under Democrat rule, and, like all institutions captured by the left, the system rewards the criminals while the victim suffers. Here’s the story, from a report at the New York Post:

An appeals court overturned the conviction of a disgraced former UCLA gynecologist serving 11 years in prison for sexually abusing patients, after determining the trial judge failed to disclose that jurors had concerns that one of their own barely spoke English.

A three-judge panel for the appeals court ruled that after a “collective concern” was expressed to the original trial judge about a particular juror’s inability to understand the proceedings because of a serious language barrier, former gynecologist James Heaps would be getting a new trial—and the victims can be revictimized all over again. Of course, Heaps has every right to be tried by an “impartial” jury, guaranteed by the Sixth Amendment, and no one would argue that a juror who “barely spoke English” would qualify as “impartial.” However, the problem is obvious: How the hell did he make it onto the jury in the first place? As the original jurors with concern stated:

‘We have observed that the language barrier with Juror [No.] 15 is preventing us from properly deliberating,’ the note read. ‘Juror [No.] 15 was not able to understand calls to vote guilty or not guilty, and expressed to us that his limited English interfered with his understanding of the testimony.’

The appeals panel concluded the same, saying that Juror No. 15 “had already made up his mind” before deliberations ended. The very opposite of impartial.
