He’s testifying before the House Judiciary Committee to discuss his investigations of President Donald Trump during the Biden administration, and to say it’s not going well for him is an understatement. Jordan began by reminding everyone about Cassidy Hutchinson, the J6 committee's “star witness” who testified during the J6 Committee’s prime-time hearing. She had made shocking allegations that were not only absurd on their face but were also based on alleged second-hand information: the claim that President Trump lunged across the back seat of his vehicle, grabbed the steering wheel, and tried to drive to the Capitol himself.

Jordan cut right to the chase, asking Smith point-blank if he thought Hutchinson was lying.

Smith immediately began hedging. "Chairman Jordan, my assessment of that particular issue is that with respect to the testimony about… the president lunging towards the driver, my recollection of her testimony about that is that it was secondhand. She said she'd heard that from somebody," he stammered.

Jordan answered Smith's weaselry with the accounts of people not speaking third-hand (one who was actually there) who stated that Hutchinson's claim did not happen.

But Jordan wasn’t done. He asked Smith if he ever confirmed Hutchinson's testimony about this specific incident. Smith tried to deflect with bureaucratic deflections about conducting independent investigations, but Jordan wasn't having it.

"Did you ever confirm it? That's a simple question," Jordan demanded.

After more evasion, Smith finally admitted the truth. "We interviewed a... another firsthand witness… who was in the car… who did not confirm… that that had happened," he confessed.

To your question, Brianna, the last Congressman we saw brought up the fact that Jack Smith demanded a trial date four months out, five months out in a case involving 13 million pages of documents. There is no defense lawyer in the country who can constitutionally prepare for trial and defend his client on that short of time frame.

The implication was you were rushing to get this in before the 2024 election. Jack Smith did not defend himself, by the way. He didn’t say a word about that, which I found, I found striking. And Jack Smith has always maintained this veneer that he never thought about the election…of course he did.  Why would would you demand such a quick trial date.

Smith admitted both on Thursday and in prior closed-door deposition that elements of Hutchinson’s testimony were based on “hearsay.” Hutchinson, a key witness for the Jan. 6 committee, claimed Trump lunged to grab the steering wheel of his presidential vehicle on Jan. 6 to redirect it the Capitol.

Yet Smith didn’t rule out calling her as a witness.

“Were you going to put her on the witness stand if you ever got to trial?” Jordan asked.

“We had not made final determinations as to who we were going to call as a witness,” Smith replied.

“That’s the point,” Jordan said. “You didn’t rule out using her, or putting her on the witness stand, when everybody knows she wasn’t telling the truth. That says it all.”

3. Smith doesn’t know how much money went to confidential human sources.

Jordan asked Smith how much of the $35 million he used to prosecute Trump went towards paying confidential human sources.

Smith said he didn’t know the identity of a confidential human source who was paid $20,000, payment documents the FBI turned over to Congress in early January revealed. FBI Director Kash Patel called the payment “weaponization” on Jan. 10.

“How many other payments went to this source or other sources?” Jordan said.

“As I sit here, I do not know the answer to that question,” Smith said.
