From what I gather, a key part of the testimony was a fellow SEAL who, having been promised immunity from prosecution, admitted under oath that he asphyxiated the 15-year-old terrorist by sealing off his breathing tube with his finger. The SEAL indicated it was essentially a "mercy killing" since he knew what was going to happen to the ISIS punk when the Iraqis got hold of him.

Chief Gallagher wasn't the only one to pose with the dead punk. Yet he was the only one prosecuted.
