Hillary Clinton vs. The Second Amendment• We know from Wikileaks that Hillary Clinton has public and private positions.1 When it comes to the Second
Amendment, her public and private positions are very different. For example, during the third presidential
debate, Hillary said she supported the Second Amendment. That is her "public" position. But behind closed
doors, she told donors her true, private position: "The Supreme Court is wrong on the Second Amendment."2
• The Supreme Court has issued relatively few decisions on the Second Amendment. According to the Library
of Congress: "In June 26, 2008, in District of Columbia v. Heller, the United States Supreme Court issued its
first decision since 1939 interpreting the Second Amendment to the United States Constitution. The Court
ruled that the Second Amendment to the U.S. Constitution confers an individual right to possess a firearm for
traditionally lawful purposes such as self-defense."3
• So, Hillary Clinton must believe that the Supreme Court got the Heller decision wrong, that the court erred in
finding an individual right to possess a firearm for self-defense.
• Asked in June by George Stephanopoulos whether she believes "an individual's right to bear arms is a
constitutional right," Hillary Clinton twice refused to give a direct answer.4
• The Heller case was decided by just one vote – 5-to-4 – in a decision written by Justice Antonin Scalia. Barack
Obama's nominee to replace Justice Scalia – Merrick Garland – was on the wrong side of the Heller decision
in a lower court opinion.5 If Garland replaces Scalia, the Supreme Court will reverse Heller and declare, as
Hillary believes, that there is no individual right to own a firearm.
So, Hillary Clinton says publicly that she supports the Second Amendment. But privately she is planning to let
left-wing judges take away your Second Amendment rights.
• On gun rights, Clinton ran to the left of Bernie Sanders during the Democrat primaries.6
• Clinton says it is "incomprehensible" that we don't allow gun manufacturers to be sued into bankruptcy.7
• She has spoken glowingly of gun bans in Australia and the United Kingdom.8
• Hillary Clinton grossly exaggerates the extent of "gun violence" in America. During the third presidential
debate, Clinton claimed "33,000 people a year…die from guns." According to the Centers for Disease Control,
in 2014, 33,599 people died as a result of firearms. But 21,334 of those deaths – 64% – were suicides.9
